### Officer's Report

The site represents the area to the rear of Ballacarrooin Farm buildings, an area which has had permission for infilling ( 00 / 0185 ) granted subject ot a host of conditions about access, levels, wheelwashing and materials.

The infilling has been almost completed but not strictly in accordance with the approved plans. Infilling has also been approved on the land to the south (PA 02/2412).

The changes are across the area and the levels are lower closest to the farm buildings but higher at the sides. The changes have only limited impact except for those alongside the lane where the higher tipped area sits proud of the existing hedge and it is not clear whether the difference is to be filled in or planted.

I visited the site today and the side boundary of the infilled area is significantly overgrown with weeds including thistles, dock and grass. The actual slope and profile of the bank is not easy to see and as a natural area in a wider area of countryside is not overly intrusive. The stretch of bank between the gate and the road is the most unattractive but this area is included in the Braddan Plan as being suitable for residential development in association with the existing house and outbuildings and as such this area will be dealt with and tidied up as part of this scheme. The present banking was introduced in order to prevent fly tipping which was occurring on the site. The lane is not a public right of way and as such the public view from the road is not unobjectionable. The infilled area has been seeded but not weeded. I suggested that the applicant may like to contact the Manx Wildlife Trust for advice about the maintenance of this area if it is not to be used for any particular purpose (grazing would be difficult due to limited access and the slope and we would not like to see buildings this far down the site.

No objections have been lodged in respect of this aspect of the site and the Commissioners' requirement for top soil and seeding has already been undertaken.

## **C 1.**

This approval relates to the infilling which has been undertaken on the site and as is shown in drawings reference 155/01, 05 and 06 received on 9th March, 2004.

## **C 2.**

If it has not already been undertaken, the site must be provided with a layer (minimum depth of 100mm) of top soil and this must be seeded prior to the end of March 2005.

## **N 3.**

The applicant may wish to consult the Manx Wildlife Trust in respect of the planting, maintenance and use of the land which is not to be used as part of a domestic curtilage or for grazing.
