## Schedule Of Conditions

**Application Ref No:** 04/00641/B

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to the plans and information submitted as part of this application and date stamped 31st March 2004.

3. The dwelling shall not be occupied until the parking facilities and vehicular access have been completed to the satisfaction of the Planning Authority after consultation with the Highway Authority, and such facilities shall thereafter be so retained.

4. The proposed development must be connected to the public foul sewer in a manner acceptable to the Department of Transport Drainage Division and on terms and conditions, which must be agreed with the Division PRIOR to the commencement of any building works. All drainage works must conform to the requirements of the Department of Transports "Manx Sewers for Adoption" and all necessary inspections/surveys [including CCTV] are to be carried out at the developer's expense. It is also a legal requirement under the Sewerage Act 1999 that the Department (as the drainage authority) be advised, in advance, of the date of the connection of each dwelling to the public sewer(s).

**NOTE:** Communication Fees will be payable to the Department of Transport in respect of each of the nine storage units.)

5. There must be no discharge of surface water to the main foul sewer.

**NOTE:** The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

### Notes On Rights Of Review Of The Initial Decision

1. If you are dissatisfied with the initial decision you may, within 21 days from the date of issue of the attached notice, request the Planning Committee to review that initial decision.

Any review request must be in writing, addressed to the Secretary of the Planning Committee, Murray House, Mount Havelock, Douglas.
2. If a review request is made by:-
a) the applicant;
b) the owner or occupier of the land;
c) the local authority in whose district the said land is situated;
the Planning Committee must accept the request for a review.
3. If a review request is made by a person who submitted a view in respect of the application the Planning Committee must determine whether or not that person has sufficient interest in the subject matter of the decision, before determining whether or not to accept the review request.

IT IS IMPORTANT, if you feel you should be accepted as having sufficient interest, that you inform the Planning Committee of:-
a) the relationship between your land or building(s) and the land that is the subject of the application; and
b) how you would be affected by the subject matter of the decision.
4. On receipt of a valid request, the Planning Committee will inform by letter:-
a) the applicant;
b) the owner or occupier of the land;
c) the local authority in whose district the said land is situated;
d) every other person with sufficient interest in the application.

That it intends to review their decision after a period of 21 days from the date of that letter.
