### Officer's Report

#### The Site

The site represents the curtilage of the Beachcomber cafe with associated flats and entertainment facilities, located on the southern side of Shore Road between the Bay Hotel and the Herdman Institute. The building is a long, flat roofed structure of limited character and relatively poor appearance compared with the adjacent buildings and its prominent location. Planning permission was granted for the principle of the redevelopment of the site for residential purposes (see below) but unfortunately this has not been taken up.

#### Planning Status

The site lies within an area of Tourism/Residential on the Port Erin Local Plan of 1990. On the draft Southern Area Plan published on 23rd October, 2009 the site lies within an area of Mixed Use, stretching from the Herdman Institute to the centre of the village. The site also lies within a proposed Conservation Area on the draft plan although this will be pursued through a process separate from the area plan.

## The Proposal

Proposed now are various new developments at the site including:

1) the erection of two timber sheds 2.1 m by 3.9 m and 2.5 m high and 1.8 m by 2.4 m and 2.4 m high, to the rear of the building
2) the erection of an open barbecue area on the first floor deck: this structure will be 2.1 m and 3 m high and with timber posts and a timber tiled roof.
3) erection of a lean-to MEA cupboard on the first floor deck
4) creation of ramped access for disabled patrons and handrails on two points of the front elevation
5) erection of a canopy on first floor eastern elevation
6) erection of flagpole on the first floor deck
7) installation of two balconies on the front elevation

Following concerns expressed by the Highway Authority the applicant has withdrawn the barriers from the application.

### Representations

Port Erin Commissioners raise no objections but express concern at the lack of bin storage. After consultation with the applicant they no longer object to the application.

Highways and Traffic Division indicate that the proposal is unacceptable as there is insufficient space for the barriers to be erected and the railings outside the main entrance obstruct a dropped kerb. Now that the barriers are to be omitted, the Highways Authority has no objection to the application.

### Assessment

The premises are an existing operation in an existing building which, whilst not overly attractive, is there and which provides tourist-related services in a prime tourist area of the village. The proposed alterations and new facilities will complement the range of facilities available at the site without any detrimental visual or other impact. There is a footpath access to the properties to the rear Beachmount and Highcliffe, which runs to the rear of the building although there is a fully made up vehicular access to these properties from the front.

## Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the alterations and new structures all shown in drawings 1142-05A, 1142-06 and 1142-07 all received on 4th August, 2010. No approval is granted to the erection of barriers as shown in the submitted drawings.
