### Officer's Report

### The Site

The site represents the curtilage of an approved plot within a developing estate to the south west of Castletown centre. The estate comprises 41 new dwellings and the conversion of barns to further dwelling units. The plot which is the subject of this application sits in the centre of the site, fronting onto an area of public open space and backing onto a rear parking area. The property approved on the plot is a semi-detached house which faces towards the south east.

### Planning Status

The site lies within an area designated on the Castletown Local Plan of 1991 as Predominantly Residential. On the draft Southern Area Plan which was published on 23rd October, 2009 the site is identified as Residential with an area of Public Open Space and a site of archaeological interest in the north western corner.

## PLANNING HISTORY

Planning permission was granted for the development of the estate under PA 04/2083 and this scheme was amended under PAs 09/1335, 09/1949, 10/0241, 10/0600, 10/0837.

## The Proposal

Proposed now is the construction of a larger garage in the parking area at the rear of the plot, than previously approved. What was permitted was a single garage, matching that attached to the garage to the south west associated with plot 9 . What is now proposed is a double garage and a single parking space alongside. The garage will be 5.75 m wide instead of 3 m as approved.

### Representations

Castletown Commissioners and the Highways and Traffic Division indicate that they do not oppose the application

The Isle of Man Water and Sewerage Authority request that conditions are attached to require that no surface water is discharged to the main foul sewer. The application states that surface water will be discharged to the surface water sewer and as such no such condition is required.

### Assessment

The proposal will retain two spaces for the dwelling in line with the parking standards set out in the Strategic Plan, Appendix Seven. In fact the site has up to three spaces available to it, if two vehicles are to be parked in the new garage. As such there is no adverse impact from the proposal.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

The Isle of Man Water and Sewerage Authority are a statutory authority and should be afforded part status in this instance.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.
