### THE TOWN AND COUNTRY PLANNING (DEVELOPMENT PROCEDURE) (No 2) ORDER 2013

In pursuance of his powers under the above Act and Order, the Minister for Infrastructure, the Hon P A Gawne MHK, does hereby in the name of and on behalf of the Department **APPROVE** planning application 14/01137/B by Mr William James McCracken for Erection of a workshop/garage/store building at Field 613057, Ballamenagh Moar Farm, Ballamenagh Road, Baldrine, IM4 6AJ, subject to the following condition(s):-

1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

**Reason:** To comply with article 14 of the Town and Country Planning (Development Procedure) (No 2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

2. Prior to the commencement of any works on the site, accurate drawings showing the approved building shall be submitted and approved in writing by the Department of Infrastructure, Planning and Building Control. Such drawings shall show full and complete details of the proposed building, including but not limited to: the thickness of the walls, eave detailing, and the colour of materials of windows, doors and rainwater goods. The development shall not be implemented other than in accordance with these approved details.

**Reason:** In the interest of the character and appearance of the development and the area within which it sits.

3. The building hereby approved shall be used primarily for agricultural purposes. The building shall be removed, and the ground restored to its former condition, in the event that it is no longer used or required for agricultural purposes.

**Reason:** The building has been exceptionally approved solely to meet agricultural need and its subsequent retention would result in an unwarranted intrusion in the countryside.

Note: This approval relates to an OS location plan and a site plan (each to be interpreted having regard to the correct boundary with the original Ballamenagh Moar Farmhouse), annotated aerial photographs and a sketch drawing, all date stamped as received on 30 September 2014.
