## The Town And Country Planning Act 1999

### The Town And Country Planning (Development Procedure) (No 2) Order 2013

In pursuance of the powers under the above Act and Order, the Hon R H Quayle MHK, following consideration of the report by the appointed person, does hereby in the name of and on behalf of the Department allow the appeal, in part, the effect of which is to **APPROVE** the Erection of four lighting columns at Bowling Green, Breagle Glen, Saint Mary’s Road, Port Erin, IM9 6JJ, without compliance with Condition 3 attached to the approval issued on 14 August 2009 reference PA09/00979/B but subject instead to the following conditions:

1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

**Reason:** To comply with article 14 of the Town and Country Planning (Development Procedure)(No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

2. The development hereby permitted shall not be carried out except in full accordance with drawings 01 and 02 all date stamped as received by the Department on 2 May 2014.

**Reason:** For the avoidance of doubt.

3. The lights must not be illuminated earlier that 1 April, or between 24 May and 25 July or after 30 September, in any calendar year. The lights must not be illuminated later than 21.30 hrs or earlier than 17.00 hrs on any one day.

**Reason:** To safeguard residential amenity.

4. The existing vegetation on and around the pole numbered 2 must be retained and maintained so as to help screen this pole. If any trees or plants are removed or die, they must be replaced by the same or similar species in the next planting season.

**Reason:** To safeguard residential amenity.
