## The Town and Country Planning (Development Procedure) Order 2005

In pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to REFUSE planning application by Orchid Holdings, ref 12/01682/B, for the removal of a chimney stack at 1 Waverley Terrace Douglas Isle Of Man IM2 3HZ for the following reason(s):

1. The stacks are significant in size and provide rhythm to the terrace and as such it is considered that the loss of the stack would have an adverse impact on the property and the Conservation Area in which it is situated, contrary to the requirements of Environment Policy 35 of the Strategic Plan.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
