### Officer's Report

#### The Site

The application site represents the residential curtilage of Croit-Ny-Kiyt, Crossag Road, Ballasalla which is a two storey detached property located on the western side of Crossag Road and on the junction with Fildraw Road.

The property is a traditional cottage, similar to others in the vicinity. The property has large window apertures on the first floor on each side of a central window, which are subdivided into three sections with a square top light in each. The property faces east and the rear garden faces onto the Silverburn River with the public footpath to the west of this some 60m away from the rear of the dwelling.

#### The Proposal

This application seeks approval for the installation of replacement front and back doors.

#### Planning Status

The application site is within an area recognised as being an area of "whiteland" under the Isle of Man Development Order 1982. The site is within a Conservation Area and an area zoned as High Landscape or Coastal Value and Scenic Significance.

Under the Modified Draft Area Plan for the South the site is zoned as being within "Predominantly Residential" and under the Landscape Assessment is within an area is characterised as being "Incised Inland Slopes".

Relevant policies include:
- Isle of Man Development Order 1982
- The Isle of Man Strategic Plan (20th June 2007)
- Modified Draft Area Plan for the South

Due to the site location, zoning and the type of proposal, the following policy is relevant for consideration:

"Environment

Policy 2: The present system of landscape classification of Areas of High Landscape or Coastal Value and Scenic Significance (AHLV's) as shown on the 1982 Development Plan and subsequent Local and Area Plans will be used as a basis for development control until such time as it is superseded by a landscape classification which will introduce different categories of landscape and policies and guidance for control therein. Within these areas the protection of the character of the landscape will be the most important consideration unless it can be shown that:

- (a) the development would not harm the character and quality of the landscape; or
- (b) the location for the development is essential."

"Environment

Policy 35: Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

PLANNING HISTORY There have been previous planning applications submitted on the site and these are as follows: Installation of solar panel on roof - 10/00674/B – APPROVED Construction of a flat roof extension to replace existing conservatory on rear elevation - 07/00837/B – APPROVED Installation of coated aluminium windows to replace existing to front elevation - 03/01530/B – APPROVED Installation of uPVC replacement windows and door to front elevation - 02/02454/B - REFUSED REPRESENTATIONS

Malew Parish Commissioners:-
"No objection"

The Authority has received no other privately written representations objecting to the application.

## ASSESSMENT

As the site is within a Conservation Area Environment Policy 35 is relevant for consideration. This policy states that development will only be permitted which would preserve or enhance the character or appearance of the Area.

To the front elevation the proposal would replace an existing painted (black) timber door with two arched glazed windows with a black uPVC door with two glazed windows.

The rear door again would be replaced with a black uPVC door which has glazing to the top half of the door.

Discussing the application with the Conservation Officer, he does not believe the existing front door is not the original door or design. He has considered the new scheme and has no objection with the design as long as the proposal is coloured black.

Therefore the question is whether this proposal would protect or enhance the appearance of the conservation area. After visiting the area, studying the plans and discussing the application with the Conversation Officer, it is considered the proposal would preserve the Conservation Area.

### Recommendation

In conclusion, it is recommended that the planning application be approved on the planning policy grounds that the development would be acceptable to the Isle of Man Strategic Plan (June 2007).

### Party Status

It is considered that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status:

#### Malew Parish Commissioners

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

## **C 1.**

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

This approval relates to the installation of replacement front and back doors as proposed in the submitted documents and drawing 11/35/01 all received on 12th July 2011.

I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager.
