### Officer's Report

#### The Site

The application site is the curtilage of Bridson House, Bridson Street, Port Erin which is a detached building which accommodates five residential apartments, hair salon and an office.

#### The Proposal

The application seeks approval for the additional use of the five self contained apartments as tourist accommodation.

#### Planning History

The previous planning applications are not considered specifically material in the assessment of the current application.

#### Development Plan Policies

The application site is in an area zoned as "Predominantly Residential" identified on the Port Erin Local Plan 1990. It is appropriate to consider Business Policy 13 of the Isle of Man Strategic Plan (20th June 2007).

## Consultations

Highways Division do not oppose has no adverse traffic management, parking or road safety implications. No material change to parking situation.

Port Erin Commissioners recommend that the application be approved.

Department of Environment, Food and Agriculture have submitted comments.

## Assessment

Given the nature of the application it is appropriate to consider Business Policy 13 of the Strategic Plan, which states:

"Permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents."

The application seeks approval for the additional use of the five self contained apartments as tourist accommodation. Although the site is in an area zoned as predominantly residential use on the 1990 Local Plan, there is an area zoned as mixed use opposite the application site and an area zoned as Tourism which is adjacent to the application site.

The site is already being used as five self contained residential apartments; it is considered that the additional use as tourist accommodation would not significantly increase the number of users of the site.

Given the close proximity of an existing hotel and tourist apartments, it is considered that the additional use of this building would not significantly alter the existing situation, therefore not unduly impacting the amenities of local residents.

No alterations are proposed externally, it is judged that the proposed development would not have a harmful impact on the character and appearance of the building or the street scene in general.

For the above reasons the application is considered to be acceptable and is recommended for approval.

## Party Status

The local authority, Port Erin Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
