In pursuance of powers granted under the above Act and Order the Department of Infrastructure does hereby **APPROVE** the following application made on behalf of:

which was considered on 15th February 2011, subject to compliance with the **conditions** specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This permission relates to the construction of a clubhouse and car parking area all as shown in drawings reference 1220-00A received on 24th December, 2010, 1220/110A, 1220/111A, 1220-112, 1220-113A, 1220-114, 1220-115A, 1220-116A, 1220-117 all received on 20th December, 2010.

3. No development may commence until such times as the new access onto the A7 Main Road has been set out and available for use as shown in the drawings approved under PA 09/0340.

4. The clubhouse may be used for the purposes of a football club and for purposes ancillary or incidental to playing football (including spectating, changing, and serving).

5. Except as provided by condition (6) below, the clubhouse shall be closed and no person shall be inside the clubhouse building, except for security or anti-crime purposes, outside the hours of 0730 - 2245 on Sundays to Thursdays, and 0730 - 2345 on Fridays and Saturdays. No person other than a person authorised by the Department to carry out site inspections for enforcement purposes, shall be within the application site outside the hours of 0730 - 2255 on Sundays to Thursdays of 0730 - 2355 on Fridays and Saturdays.

6. The Department may, on written application by Colby AFC Limited, approve a variation of the hours specified in condition 5 above on no more than 6 occasions in any calendar year: such variation shall not in any instance permit people to be within the clubhouse between 0100 - 0730 hours or within the application site between 0110 and 0730 hours.

7. The implementation of the development may not be undertaken during the railway operating season until such times as the railway crossing has been put in place as shown and described in PA 09/0430.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
