In pursuance of powers granted under the above Act and Regulations the Department of Infrastructure does hereby **REFUSE** the following application made on behalf of:

**Name:** Mr James Cryan **Proposal:** Installation of an awning and signage (Retrospective) (In association with 10/01588/CON) **at:** Kings Guest House Queens Promenade Douglas Isle of Man IM2 4PL which was considered on 13th October 2011, for the reasons set out below. **Date of Issue:** 17th October 2011

### Reason(S) For Refusal:

1) The erection of an advertising canopy would be contrary to General Policy 2 and Environment Policies 32, 35 and 37 of the Isle of Man Strategic Plan 2007 in that the canopy appears as a tacked on addition to the building and essentially is an alien feature to the building. It is judged that the retention of the canopy would not ensure that the special features contributing to the character of the Conservation Area are preserved or enhanced and would adversely affect the setting of the registered building.

This decision was made by the Development Control Manager under the authority delegated by the Department under Regulation 6(2) of the Control of Advertisements Regulations 2005.

- Any appeal has been determined;

Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
