### Officer's Report

#### The Site

The site represents an enclosed but generally unused area within Balthane Industrial Estate, alongside agricultural land and in the south eastern area of the estate. The site is accessed via a 4 September 2008 08/00481/B Page 1 of 4

straight made up road which joins the main estate road. The site has large scale warehouse-style buildings to its north west and south west and to the north is an area which has permission for the creation of temporary works compound including offices, associated car parking and area for storage of building materials (PA 03/0951).

## Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Existing Industrial.

### Planning History

Planning permission has been sought for the development and use of the application site and for the wider area around and including the site as follows:

PA 88/0047 - approval in principle for factory premises - permitted (land including the site and to the west) PA 90/1012 - layout of 13 industrial plots, roads and sewers - permitted (including the site and a much wider area) PA 92/1336 - layout of 5 industrial plots, roads and sewers - permitted (as above) PA 95/1070 - erection of an industrial unit with offices - permitted (part of the site) PA 97/0686 - approval in principle for erection of industrial unit, car parking and road extension permitted (part of the site) PA 00/2408 - change of use to provide secure private parking - permitted (application site only) PA 03/1532 - change of use of storage site to waste transfer station for storage prior to shipment off Island - refused on appeal and PA 03/1929 - erection of six security light columns - permitted on appeal

### The Proposal

Proposed is the erection of a storage warehouse which will be 23.3 m wide and 32.5 m long and 11.5 m to the ridge. The building will be clad in profiled sheeting with a small two storey office and canteen annex on the south eastern elevation. There is no parking provision shown on the plans. The parking ratio to be applied is 1 space per 100 square metres of gross space. As such, the proposal would require 8 spaces for the storage facility and 2 for the office.

### Representations

Manx Electricity Authority recommends a note regarding existing electricity supplies which is a matter for the applicant when undertaking the development and should not be referred to in the planning decision notice.

Department of Transport Drainage Division recommend conditions regarding drainage of the site Malew Parish Commissioners indicate that they have no objection to the application The Isle of Man Fire and Rescue Service recommend consultation regarding fire safety which are not material planning considerations in this instance and should not be referred to in the planning decision notice.

### Assessment

The applicant has submitted further plans which illustrate drainage and parking within the site to the satisfaction of both the Drainage Division and Highways and Traffic Division of Department of Transport. The development will make provisions ten parking spaces with sufficient space remaining for the manoeuvring of large vehicles from the building.

The further plans have demonstrated that the development of the building and associated facilities, is acceptable.

Some of the matters referred to in the communication from Department of Transport Drainage Division are either proposed in the application (connected to the main sewer for the disposal of foul sewage) or are matters which are dealt with as part of the Building Regulations (identification of the main sewer) and as such should not be referred to in the planning decision notice. The application suggests that surface water is to be discharged either to the main foul sewer, which is not acceptable to the drainage authority, or to a stream which will require a licence. A condition should be attached to ensure that surface water is not discharged to the main sewer.

## **PARTY STATUS**

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Manx Electricity Authority and The Isle of Man Fire and Rescue Service raise issues which are not material planning matters and as such should not be afforded party status in this instance.

## **C 1.**

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

## **C 2.**

This permission relates to the erection of an industrial building and associated access, drainage and parking as shown in drawings 0701/PL01 D received on 7th August, 2008 and 0701/PL02 received on 10th March, 2008.

## **C 3.**

The building may only be used for the purposes of storage and/or distribution in accordance with Class 6 of the Use Classes Order (Schedule 4 of the Isle of Man Planning Schem (Permitted Development) Order 2005.
