# Planning Refusal Notice

## Town and Country Planning Act 1999

### Town and Country (Development Procedure) Order 2005

Penketh - Millar
23 West Quay
Ramsey
Isle of Man
IM8 1DL

In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **REFUSE** the following application made on behalf of:

**Name:** Mr & Mrs A R Proctor
**Proposal:** Approval in principle to convert existing outbuilding into two self contained units to provide ancillary accommodation
**at:** Middle Kerrowglass
Peel Road
Kirk Michael
Isle of Man
IM6 1HN

which was considered on 30th October 2008, for the reasons set out below.

**Date of Issue:** 3rd November 2008

**Murray House Mount Havelock Douglas**
*(Signature: Murray House, handwritten signature)*

**Deputy Secretary to the Planning Committee**
*(Signature: Deputy Secretary to the Planning Committee, handwritten signature)*

---

### Reason(S) For Refusal:

1. Whilst the principle of converting the barns is in accordance with Housing Policy 11, the two self-contained units of accommodation and level of traffic that would be generated by such development would result in an increase in vehicles entering into and exiting from the existing lane. Due to the limited visibility onto the main road, the access is considered to be unsuitable to serve the proposed development, and would prejudice highway safety, contrary to Transport Policy 4 of the Isle of Man Strategic Plan 2007. *(Handwritten: 28)*

This decision was made by the Acting Senior Planning Officer in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

*(Handwritten signature and date: 08/01270/A)*
