### Officer's Report

**SITE**

The application site comprises of a warehouse building at No 8-10 Allan Street, which located on the north western side of Allan Street. To the north east of the application site is a car park and to the south west is the residential property of No.12 Allan Street. The application site is zoned as predominantly residential in the Douglas Local Plan 1998.

## **PROPOSED DEVELOPMENT**

The application is seeking to vary condition 3 of Planning Permission no.97/0041 to allow sales from the site to take place on Thursdays between 1-4pm.

## **PLANNING STATUS AND RELEVANT POLICIES**

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2

## Planning History

The following previous applications are considered relevant in the consideration of this application: 97/0041 - Conversion of workshop to warehouse/sales - granted June 1997 Condition 3 of the permission states that "Sales from the site may take place only on Saturdays."

### Representations

Highways Division of the Department of Transport have not commented on the application Douglas Corporation does not object to the application. The occupiers of No's 8 and 12 Allan Street have objected to the application on the grounds of congestion and increased parking problems.

### Assessment

The main consideration in assessing this application is whether Thursday trading will cause any particular parking problems within the locality.

At present the applicants open on Saturday afternoons between the hours 1-4pm. They would like to open on Thursday afternoons to help to minimize the amount on people on a Saturday. The applicant has carried out a survey on Saturday 7th June to demonstrate the amount of people who visit the site. In the first hour of trading over 125 people visited the site, then 50 people + in the second hour of trading and then in the third hour 25 people visited.

The applicants have indicated that visitors to the site are able to park in the adjacent car park on Saturdays; however, this will not be case on Thursdays as the car park will be in use by office workers. This will lead to visitors parking on the public highway; however, it is difficult to assess whether the proposal will cause any parking problems within the locality as the applicant does not know how many visitors will visit on a Thursday. The local residents concerns about parking are noted; however, it is considered that a pragmatic approach be taken with regard to this application. It is recommended that a temporary planning permission for 1 year should be granted so as to assess the parking situation during the extended opening hours.

### Recommendation

It is recommended that the planning permission be granted subject to conditions.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

It is considered that all parties who made representations to the planning application comply with the requirements of Planning Circular 1/06 - Determination of Interested Party Status.

This permission relates to extension of the existing opening hours for a period of 12 months from the date of this notice; at the expiry of this period, the use shall revert back to the original opening times, as stated in conditions 3 of Planning Permission 97/00041 dated 30th June 1997, unless there is by that date planning permission for a further period.

This permission relates to the extension of opening hours as shown in application forms and drawing numbers 00528/1 and S101 Rev PO date stamped 27th March 2008.

Sales from the site may take place between 1300 hours and 1600 hours on Thursdays and anytime on Saturdays.
