## Town and Country Planning Act 1999 - The Town and Country Planning (Development Procedure) (No 2) Order 2013

I refer to the planning application 14/00139/A by Marown Parish Commissioners for the Approval in principle for erection of a multi-purpose shop at Field 320977 Ballawilleykilley Main Road Crosby Isle of Man.

The Department of Infrastructure determined to **REFUSE** the planning application and in doing so has given you interested party status. A copy of the Officer’s report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

The refusal is for the following reason:

1. Whilst the Commissioners should be applauded for looking at ways in which the local communities can be better served, in this case, whilst preliminary investigations which the Commissioners undertook may have indicated that there was significant support for a local shop, this is not manifest in the views submitted to this application which are mainly opposed to the development. In the absence of demonstrable local support for the development it is considered that there is insufficient justification to set aside the land use designation of the site as Open Space and of High Landscape Value and Scenic Significance and also in view of the precedent which could be established for further development in this particular area, thus undermining the visual separation of Crosby and Glen Vine.

This decision was made by the Planning Committee in accordance with the authority delegated to it.

Should you wish to appeal against this decision your request must be in accordance with Article 8 of the Order, specifically, in writing, signed by you as appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal your request must contain:

- Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150);
- The reasons for making the appeal; and

- An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
