It is concluded that the planning application accords with the provisions set out in General Policy 2, Paragraph 8.12.1, Environment Policy 42, and Transport Policy 7 of the Isle of Man Strategic Plan 2016.

Officer’s Report THE SITE

1.1 The application site is within the curtilage of 66 Slieau Curn Park, Kirk Michael which is a semi-detached bungalow situated to the Western side of the last Slieau Curn Park cul-de-sac. THE PROPOSAL - 2.1 The current application seeks approval for the erection of a storage/ summerhouse with a slight slanting roof to the front elevation which is to measure approximately 4.6m by 1.6m with an overall height of 2.6m. The storage/ summerhouse is to be split into two parts a storage part which is to open up to the driveway and a summerhouse part which is to open up to the rear garden. There is a window situated in the summerhouse which faces onto the main dwelling. PLANNING HISTORY - 3.1 The site has been subject to the following applications; PA24/01190/Law - Certificate of Lawful Development for installation of a flue for a multi-fuel stove - Agreed PA03/00843/B - Installation of roof lights to front and rear elevations - Permitted. PLANNING POLICY - 4.1 The site lies within an area zoned as "Predominantly Residential No.5" on the Kirk Michael Local Plan 1994, Map. The site is not within a Conservation Area nor a Flood Risk Zone.

4.2 Given the nature of the site and the land designation, the most relevant Isle of Man Strategic Plan policies would be General Policy 2 which sets out the general standards towards acceptable development and Transport Policy 7 in connection with Appendix 7 which sets out the relevant parking standards. REPRESENTATIONS - 5.1 DOI Highway Services and Michael Commissioners were consulted on the 27th October 2025 of which at the time of writing this report no consultation has been received. ASSESSMENT - 6.1 The main issues to consider in the assessment of this planning application are:

- - character and appearance (GP2, b,c)
- - highway issues (TP7)

## - 6.2 CHARACTER AND APPEARANCE

- 6.2.1 Paragraph 8.12.1 of the Isle of Man Strategic Plan 2016 states that there will be a general presumption in favour of extensions or alterations to existing properties where such works would not have an adverse impact on either adjacent properties or the surrounding streetscene in general.
- 6.2.2 The proposed shed is small in sizing and low in height, and due to its location whilst on the front elevation it would be adjacent to already existing fencing of the neighbours property to the North of the site, as such the overall any impact on the character and appearance of the area and the site itself would be minimal and in accordance with General Policy 2, Strategic Policies 3(b) and 5 and Environment Policy 42.
- 6.3 IMPACT ON PARKING AND HIGHWAY SAFETY

- 6.3.1 Turning towards the proposed storage/ summerhouse and the impact on parking as the proposed shed is situated upon the existing parking apron for the application site.
- 6.3.2 Overall the site would still have parking for two vehicles which would comply with Transport Policy 7 in connection with Appendix 7 of the Isle of Man Strategic Plan 2016.

## CONCLUSION

7.1 For the reasons set out above, the proposed development is deemed acceptable and it is concluded that the planning application accords with the provisions set out in General Policy 2, Paragraph 8.12.1, Environment Policy 42, and Transport Policy 7 of the Isle of Man Strategic Plan 2016, and as such is recommended for approval. RIGHT TO APPEAL AND RIGHT TO GIVE EVIDENCE - 8.1 The Town and Country Planning (Development Procedure) Order 2019 sets out the process for determining planning applications (including appeals). It sets out a Right to Appeal (i.e. to submit an appeal against a planning decision) and a Right to Give Evidence at Appeals (i.e. to participate in an appeal if one is submitted).

8.2 Article A10 sets out that the right to appeal is available to:

- o applicant (in all cases);
- o a Local Authority; Government Department; Manx Utilities; and Manx National Heritage that submit a relevant objection; and
- o any other person who has made an objection that meets specified criteria.

8.3 Article 8(2)(a) requires that in determining an application, the Department must decide who has a right to appeal, in accordance with the criteria set out in article A10. - 8.4 The Order automatically affords the Right to Give Evidence to the following (no determination is required):

- o any appellant or potential appellant (which includes the applicant);
- o the Department of Environment, Food and Agriculture, the Department of Infrastructure and the local authority for the area;
- o any other person who has submitted written representations (this can include other Government Departments and Local Authorities); and
- o in the case of a petition, a single representative.

I can confirm that this decision has been made by a Principal Planner in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded interested person status and/or rights to appeal.
