In pursuance of their powers under the above Acts and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby APPROVE the application made by you on behalf of

Demolition of property and construction of retail store with associated car parking, 11-17 Arbory Street, Castletown.

which was considered at a meeting held on the 20th December, 1989, subject to the compliance with the conditions or modifications specified on the attached schedule, numbered 1 to 13.

Note 1: This permission refers only to that required under the Town & Country Planning Acts and does not include any consent or approval under any other enactment, byelaw, order or regulation.

Note 2: NO WORKS MAY BE COMMENCED UNTIL SUCH TIME AS -

a) the time for requesting a review of the initial decision has expired; or
b) any review of the initial decision has been completed; or
c) the time for requesting an appeal in relation to any decision at review has expired; or
d) any appeal has been completed.

Note 3: Rights of review against the decision of the Planning Committee are attached.

The building(s) shall not be used for any other purpose than that indicated on the plan or in the application without the consent of the Committee.

The development shall be completed within the period of FORTY EIGHT (48) months from the date of this approval WHICH SHALL CEASE TO HAVE EFFECT IN DEFAULT OF COMPLIANCE WITH THIS CONDITION except in respect of any development completed within that period.

Subject to the last foregoing condition the development having been commenced shall be carried on to completion in a workmanlike and expeditious manner to the satisfaction of the Planning Committee and if not so completed within the said period of FORTY-EIGHT (48) months it shall be a further condition of this approval that the applicant shall submit a new application for consideration by the Committee in respect of the uncompleted development.

This approval relates to the following drawings:-

(a) 1014/1,/2,/3 received on the 22nd November, 1989;
(b) 1014/12A,/13A,/14A,/16,/17 received on the 8th December, 1989; and
(c) 1014/15A (modified front elevation) received on the 19th December, 1989;

except insofar as modification thereof is required by conditions (5) and (10) below.

The detailed design of the doors and archway at the front of the building must be revised in consultation with the Department’s Architect and Planning Officer, and an amended plan incorporating such revision must be submitted to, and approved by, the Planning Committee PRIOR to the commencement of any development.

A sample of the roof materials and colour of render must be submitted to and approved by the Committee PRIOR to the commencement of any building works.

All services including electricity and telephone must be laid underground to the satisfaction of the Committee and arrangements for the supply of such services acceptable to the Committee must be made PRIOR to the commencement of any building works.

The proposed development must be connected to the main sewer in a manner acceptable to the Byelaw Officer and the Committee and on terms and conditions to be agreed with the Castletown Commissioners PRIOR to the commencement of any building works.

The Manx Museum and National Trust must be informed of the date when building work is to commence and given adequate opportunity to inspect the site from the commencement of earth movement and during the excavation of all trenches (including service trenches) as deemed necessary and investigating any archaeological and geological features exposed, to the satisfaction of the Committee.
NOTE: The applicant's attention is drawn to the contents of the Manx Museum and National Trust Act 1959/1986.

Adequate fire precautions must be taken including the provision of an additional fire exit at the western end of the Arbory Street frontage, fire alarms, emergency lighting, and fire extinguishers, to the satisfaction of the Committee and the Chief Fire Officer who must be consulted thereon PRIOR to the commencement of any development works.

An amended plan in accordance herewith must be submitted to, and approved by, the Planning Committee PRIOR to the commencement of any development.

No advertisement matter of any description shall be exhibited at this site without the PRIOR written permission of the Committee.

All entrances and exits must be suitable for use by unassisted wheelchair users, and must be designed, in accordance with BS5810, without steps of any sort.

Three of the proposed car parking spaces adjoining the building must be designated as two spaces for use by disabled drivers.
