TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure) Order 2019

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Mrs Lorraine Lees Jweinat, Ref 25/90855/A, for the Application in Principle (including details of means of access) for the erection of a dwelling with access onto Packhorse Lane at Land Between Newlands House And Briardene Main Road Baldrine Isle Of Man IM4 6DX.

Any conditions or notes which apply to the approval are set out below. This approval is subject to compliance with any conditions listed and may not be implemented until it becomes final (see guidance notes).

- 1. The development hereby approved shall be begun either before the expiration of four years from the date of this approval or before the expiration of two years from the date of approval of the last of the reserved matters.

Reason: To comply with article 26 of the Town and Country Planning (Development Procedure) Order 2019

- 2. Approval of the details of siting, design, external appearance of the building[s], internal layout, drainage (foul & surface water) and landscaping of the site (hereinafter called "the reserved matters") shall be obtained from the Department in writing before any development is commenced. Reason: To comply with the Town and Country Planning (Development Procedure) Order 2019.
- 3. Application for approval of the reserved matters shall be made to the Department before the expiration of two years from the date of this approval and thereafter the development shall only be carried out in accordance with the details as approved. Reason: To avoid the accumulation of unimplemented planning approvals.
- 4. Any future reserved matters application concerning trees shall include a detailed Arboricultural Impact Assessment and Tree protection Plan TPP to support the preposition that no trees will be lost. Reason: In the interests of retention of existing trees and appearance of the area.

- 5. The dwelling hereby approved shall not be occupied until the means of vehicular access and visibility splays as identified on approved drawing 25 1932 09 have been constructed in accordance with the approved plans, and shall thereafter be retained for access purposes only. Reason: In the interests of highway safety.
- 6. Any future reserved matters application shall include details of bird boxes within the site. Reason: In the interests of ecology. This approval relates to the submitted documents and drawings reference numbers all received; 15.09.2025

This decision has been made for the following reasons(s) At this stage the Department is comfortable that a single dwelling on the site could be accommodated; albeit a future Reserved Matters application would consider the detailed design of any dwelling and the potential impacts upon neighbouring amenities, visual amenities of the street scene and other matters outlined within this report. The access arrangement are to be considered at this stage and the Department finds these to be acceptable.

Accordingly, it is considered the proposal would comply with the relevant planning polices of the IOM Strategic Plan 2016, Residential Design Guide 2021 and the Area Plan for the East 2020

Guidance Note

This decision was made by the Planning Committee in accordance with the authority delegated to it.

This decision refers only to that applied for under the Town and Country Planning Act 1999 and its subordinate legislation.

Implementation A determination to grant planning approval does not have effect —

-  if an appeal is submitted until the appeal is determined or withdrawn; or
-  if no appeal is submitted, but there are potential appellants in addition to the applicant, until the time within which an appeal may be submitted has expired (21 days from the date of this notice).

Development must be carried out in accordance with the approved plans and any attached conditions (irrespective of any changes that may separately be requested at the Building Control stage or by any other Statutory Authority). This approval does not remove the need to also comply with any other relevant legislation.

Any conditions requiring certain works, submissions etc. prior to commencement of development must be fulfilled prior to work starting on site. Failure to adhere to this approval and meet the requirements of all conditions may invalidate this approval or result in formal enforcement action.

Appeal Any appeal can only be made by a person who has been accorded rights to do so, must be in writing, include the appropriate fee and be submitted to the Department within 21 days of the date of this Notice.
