I refer to the appeal in respect of the above planning application.

In accordance with the provisions of The Town and Country Planning (Development Procedure) Order 2019, I herewith give notice of the appeal decision.

The Minister for Environment, Food and Agriculture, the Hon C Barber MHK, has considered the report, concurs with the appointed person’s conclusions, and accepts the recommendation that **the appeal should be dismissed**. Accordingly, she has directed that the Department’s decision to refuse the application should be upheld, and that the application should be **Refused**. Formal notice of this decision is attached.

In pursuance of her powers under the above Act and Order/Regulations, the Minister for the Department of the Environment, Food and Agriculture, the Hon C Barber MHK does hereby in the name of and on behalf of the Department REFUSE planning application 24/00415/B by Mr & Mrs Jimmy And Janine Cubbon for Ground floor extension and alterations and Conversion of existing roof into habitable space by raising the roof, erection of 2 dormers and installation of roof lights - 1 Bradda View Ballakilloway Colby Isle Of Man IM9 4BE, for the following reason(s):-

## Reason(S) For Refusal:

1. By virtue of the increased height and overall volume of extensions this proposal would result in a prominent feature within the streetsceane which would disrupt the uniformity and cohesion in the character and appearance of this part of Bradda View, of particularly importance in the approach to the housing estate, including maintaining a sense of openness. In this way the proposal would be contrary to the Residential Design Guide, Strategic Policies 3 and 5, Environment Policy 42 and General Policy 2 of the Isle of Man Strategic Plan 2016.
