Reason: To comply with Article 26 of the Town and Country Planning (Development Procedure) Order 2019 and to avoid the accumulation of unimplemented planning approvals.

This application has been recommended for approval for the following reason.

There have been no changes to policy since the original 2019 approval to warrant reaching a different conclusion and so the application is considered acceptable and to accord with General Policy 2 of the Strategic Plan 2016, principles of the Residential Design Guide and not at odds with the character appraisal of the Port St Mary Conservation Area.

_______________________________________________________________ Interested Person Status – Additional Persons None _____________________________________________________________________________ Officer’s Report THE SITE

1.1 The site is the residential curtilage of an existing, detached, two storey dwelling known as 'Stoneleigh' situated on the western side of St. George's Crescent looking towards Breagle Glen. THE PROPOSAL - 2.1 Proposed is the extension of time for a previous approval 19/01195/B for side and rear extensions to the existing dwelling and installation of replacement windows. PLANNING HISTORY - 3.1 Approval of PA 19/01195/B is most relevant in this case. There were no conditions other than the standard 4 year approval, the decision notice is dated 18/12/2019. PLANNING POLICY - 4.1 The site is designated on the Area Plan for the South 2013 as Residential. The site also lies within Port Erin's proposed Conservation Area. The Isle of Man Strategic Plan 2016 contains the following policies considered materially relevant to the assessment:

- o Strategic Policies 3 and 5 - promote good design and use of local materials and character
- o General Policy 2 (b) (c) (g) (n) - general standards towards acceptable development visual and neighbouring amenity, and energy reduction.
- o Environment Policy 42 - promotes development taking account of locality in design.
- o Housing Policy 16 - works to dwellings in the countryside
- o Community Policy 7, 10 - prevent criminal activity and reduce spread of fire
- o Infrastructure Policy 5 - conserve the Island's water

4.2 The Residential Design Guide (July 2021) contains the following guidance also considered materially relevant:

- Section 7 Impact on Neighbouring Properties

4.3 Whilst the property lies within a proposed Conservation Area, the draft Conservation Area Appraisal contains the following advice: o St George's Crescent; this road consists of attractive villas dating from 1908 to 1950. However, the buildings are not of significant historical interest.

## - 5.0 REPRESENTATIONS

Copies of representations received can be viewed on the Government's website. This report contains summaries only.

5.1 Port Erin Commissioners - comments have been sought but nothing received as of 08/02/2024. - 5.2 Department of Infrastructure Highway Services - No highways interest (12/01/2024). - 5.3 No comments received from neighbouring properties. ASSESSMENT

6.1 The previous officer concluded that the key matters related to the visual impact on the main house and whether there would be any harm to the living conditions of the neighbours and stated that "6.2 The extension would add a hipped roofed feature to the property which has a gable ended main roof and this can sometimes appear awkward. However, the property also has a projecting pitched roofed gable on the front elevation which brings more angles to the front facade as well as bay windows which have roofs which slope up to the main walls of the front of the property. This, together with the replacement of the diamond leading to the windows will result in something which will be more modern but given the overall appearance of the property, which is not overly traditional, it is not considered that these changes are objectionable, particularly given the comments in the draft Conservation Area Appraisal….6.3 The extension will bring the property closer to existing first floor windows in Whitebridge, however, using the 25 degree measurement, it is not likely that this extension will result in an adverse impact on the outlook and light of this property. There is also another window which appears to serve the room of the first floor side window in this property."

6.2 The issues in the case of this application is whether there have been any policy changes since the 2019 approval to warrant a different decision being reached. The previous officer had regard to those policies in the Strategic Plan which are unchanged and still remain applicable now, they also had regard to the Residential Design Guide, whilst in its early stages in 2019 the principles of the updated 2021 version remain the case for assessing neighbouring impact. - 6.3 It is not considered that there have been any new policies or changes to policy that would result in a different decision now being reached and as such the extension to the 4 years to allow another 4 years up to 18/12/2027 is acceptable in this case.

## CONCLUSION

7.1 The proposal is considered to have an acceptable impact on the environment, having regard to General Policy 2, Residential Design Guidance and the draft Conservation Area Appraisal and the application for the extension of time is to be supported. INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) Order 2019, the following persons are automatically interested persons:

- (a) the applicant (including an agent acting on their behalf);
- (b) any Government Department that has made written representations that the Department considers material;
- (c) the Highways Division of the Department of Infrastructure;
- (d) Manx National Heritage where it has made written representations that the Department considers material;
- (e) Manx Utilities where it has made written representations that the Department considers material;
- (f) the local authority in whose district the land the subject of the application is situated; and
- (g) a local authority adjoining the authority referred to in paragraph (f) where that adjoining authority has made written representations that the Department considers material. 8.2 The decision maker must determine:

- o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and
- o whether there are other persons to those listed above who should be given Interested Person Status.

I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
