## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) (No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Ian George Beresford Sims & Mary Jane Sims, Ref 14/01135/B, for the variation of condition 1 of approved PA 12/01254/B (retention of existing marquee) to extend period of permission at Barroose House Barroose Road Baldrine Isle of Man IM4 6AR subject to compliance with the following condition(s):

1. This approval shall inure for the sole benefit of the applicants, Mr and Mrs Sims, for a period of 5 years from the date of this permission, on expiry of which period the structure shall be dismantled and the frame, cladding and all other constituent materials shall be removed permanently from the site.

Reason: The building has been exceptionally approved solely to meet a specific need and its subsequent retention would result in an unwarranted intrusion in the countryside.

2. The structure hereby approved shall be used only by the applicants, Mr and Mrs I Sims, and solely for agility training for dogs. Other uses of any kind are not permitted, including the use of the structure by or on behalf of other persons for training or competition events.

Reason: The building has been exceptionally approved solely to meet a specific need and its subsequent retention would result in an unwarranted intrusion in the countryside.

3. The building must only remain while Mr and Mrs I Sims (the applicants) are resident at Barroose House. Within 1 day of the applicants no longer residing at the site, the use shall cease and the structure shall be dismantled and the frame, cladding and all other constituent materials shall be removed permanently from the site.

Reason: The building has been exceptionally approved solely to meet a specific need and its subsequent retention would result in an unwarranted intrusion in the countryside.

4. All of the panels which form the roof of the marquee structure shall be white in colour.

Reason: In the interests of the character and appearance of the surrounding countryside.

This approval relates to the following plans, date-stamped as having been received 30th September 2014: HLK/12/0124 1, HLK/12/0124 2 and HLK/12/0124 3.

### Guidance Note

This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department.

This permission refers only to that required under the Town and Country Planning (Development Procedure) (No 2) Order 2013.

Any appeal against this decision must be in accordance with Article 8 of the Order.

A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

- Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150);
- The reasons for making the appeal; and
- An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.

Please note that a copy of the Officer’s report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

The proposed development must not be commenced until either;

- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department’s public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
