## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) (No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to APPROVE a planning application by Maxine Cleverley, Ref 14/01013/B, for the erection and operation of a cattery at Highfield Stoney Road Laxey Isle of Man IM4 7NB subject to compliance with the following condition(s):

1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

2. The use hereby approved shall not be carried on by any persons other than Mr M Cleverley and/or Mrs M Cleverley while he/she is occupying Highfield, Stoney Road, Laxey, unless otherwise agreed in writing by the Department.

Reason: In the interest of highway safety and residential amenity

3. All planting, seeding or turfing comprised in the approved drawing 4.7059-103 must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the cattery, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.

Reason: To ensure the provision of an appropriate landscape setting to the development.

4. The timber framed post & beam structure with a natural sedum roof as approved under drawings 4.7059-101 and 4.7059-103 is required to be erected prior to the operation of the cattery and retained and maintained thereafter.

Reason: In the interest of visual amenities of the area.

5. All alterations to the existing driveway as approved under drawing 4.7059-103 are required to be undertaken prior to the operation of the cattery and retained thereafter.

Reason: In the interest of highway safety.

6. The cattery shall only be open to visitors/customers between the hours of 0900hrs to 1100hrs and 1500hrs to 1700hrs Mondays, Tuesdays, Wednesday Thursdays and Fridays and 1300hrs to

1500hrs on Saturdays. No visitors/customers may visit the premises outside of these hours or on Sundays or Bank or Public Holidays.

Reason: In the interests of public amenity.

This approval relates to drawings numbered 4.7059 - L, 4.7059 - 101, 4.7059 - 102, 4.7059 - 103, and 14TS015 - 01 all received on 29th August 2014.

### Guidance Note

This decision was made by the Planning Committee in accordance with the authority delegated to it in the name of the Minister and/or in the name and on behalf of the Department.

This permission refers only to that required under the Town and Country Planning (Development Procedure) (No 2) Order 2013.

Any appeal against this decision must be in accordance with Article 8 of the Order.

A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

- Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150);
- The reasons for making the appeal; and
- An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.

Please note that a copy of the Officer's report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

The proposed development must not be commenced until either;

- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
