## Officer's Report

### The Site

1.1 The site is an existing residential dwelling which lies on the southern, beach side of Queen Street. The property is a traditional two storey cottage, much lower than the three storey units to the east and a similar height and character to that attached to the west. The property backs onto the stone beach and seashore to the south.

### The Proposal

2.1 Proposed is the additional use of the property as tourist accommodation as well as a dwelling for permanent residential occupation. No changes to the building are proposed and it will remain a two bedroomed unit with additional space in the attic which is served by a rear facing flat roofed dormer window.

### Planning Status And Policy

3.1 The site is designated on the Area Plan for the South adopted in 2013 as Residential and also within Castletown's Conservation Area.

3.2 The Strategic Plan contains the following which is considered relevant to this application:

Paragraph 9.5.8 states, "The use of existing private residential properties as tourist accommodation may be acceptable if it can be demonstrated that it will not compromise the amenities of any neighbouring residents."

Business Policy 13 states: "Permission will generally be given for the use of private residential properties as tourist accommodation providing that it can be demonstrated that such use would not compromise the amenities of neighbouring residents."

3.3 The Strategic Plan also contains the following policy which is considered relevant: Environment Policy 35 states "Within Conservation Areas, the Department will permit only development which would preserve or enhance the character of appearance of the area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

### Planning History

4.1 The property has been the subject of a number of applications for alterations, none of which are considered relevant to the consideration of this current application. It is relevant however that numbers 40 and 54 have permission for use as tourist accommodation (PAs 09/01351 and 01/02377).

## Representations

5.1 Castletown Commissioners and Highway Services indicate that they do not oppose the application.

## Assessment

6.1 The Strategic Plan makes it clear that the use of residential property for tourist accommodation can be acceptable provided that there are no adverse impacts on the amenities of those in neighbouring residential properties. In this case the property is close to the town centre and alongside a busy road within the town and directly alongside a public beach. As such, it is not only considered that the use of the premises for tourist accommodation would not result in an adverse impact on neighbours but also that the property is ideally situated to provide accommodation for those visiting the town and the Island.

6.2 As such the application is recommended for approval.

## Party Status

7.1 The local authority, Castletown Commissioners are, by virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, paragraph 6 (4) (e), considered "interested persons" and as such should be afforded party status.

7.2 Department of Infrastructure Highway Services is granted interested party status under the Town and Country Planning (Development Procedure) (No 2) Order 2013 paragraph 6 (4) d.

#### C 1.

The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

**Reason:** To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.
