I refer to the abovementioned planning application.

In accordance with the Article 9 of the Town and Country Planning (Development Procedure)
(No 2) Order 2013, I herewith give notice of the decision as follows.

The application has been approved subject to the following condition(s);

1. The development hereby approved shall commence before the expiration of four years from the date of this notice.

2. The development hereby approved shall not be carried out except in accordance with the following drawings: 1068-000, 1068-001 and 1068-002, all received on 6th March 2014.

In accordance with article 10(c) of the Order, please be advised that the decision of the Council of Ministers is binding and final (subject to the possibility of judicial review by petition of doleance).

Application by Island Shellfish Processing Limited for planning approval for a single storey extension to provide a new freezer room at the Island Seafare Building, The Quay, Port St Mary IM9 SEA.

1. I have the honour to report that on 19 May 2014 I carried out a site visit at the above location. The case is being made by written representations.
2. The proposed extension would be on the quay at Port St Mary, land that is owned by the Department of Infrastructure. The application is therefore one that has to be determined by the Council of Ministers, not the Planning Committee.

## Site Description And The Proposal

3. The Island Seafare Building is a brick building with a metal roof. It has a singlestorey lean-to on its northern side. The harbour and quayside adjoin to the east and there is car parking on the building's other three sides. Island Shellfish Processing Ltd want to extend the building's existing lean-to so that it reaches right to the north eastern corner of the building. The extension's footprint would measure about $4.5 \mathrm{~m} \times 2.75 \mathrm{~m}$ and it would replicate the adjoining lean-to's height, roof-slope and painted metal cladding. When built, it would provide a small freezer room.

### Representations Received

4. The Port St Mary Commissioners and the Highways Division have no objections. No other representations have been received.

### Advice From The Department Of Infrastructure'S Planning And Building Control Division

5. The site is within an area identified as "Harbour Area" on the Area Plan for the South 2013. It is also within the proposed Port St Mary Conservation Area.

### Assessment

6. The proposed extension would fill in a small corner between the 2-storey part of the building and its single-storey lean-to. It would be on the side of the building nearest to the waterfront and furthest from the dwellings in Lime Street that back onto the harbour area. Its appearance would replicate the lean-to that it would adjoin and, in my view, its presence would be scarcely noticeable to passers-by.
7. Employment Proposal 4 of the Area Plan for the South requires new industrial development in Port St Mary harbour to be marine-based, built to a high standard, and of a scale appropriate to this relatively small port. It should neither adversely affect the amenity of neighbouring residents nor prejudice the use of

the harbour area for leisure or tourist development. On all counts I am satisfied that the proposed extension would meet these requirements. It would be small and insignificant, and it would be unlikely to generate any additional noise or traffic.

8. Furthermore, when the proposed Conservation Area is designated I see no reason why it would cause harm to its character and appearance.

9. For these reasons I find the proposal to be acceptable.

### Recommendation

10. I recommend that Planning Approval be granted for a single storey extension to provide a new freezer room at the Island Seafare Building, The Quay, Port St Mary IM9 5EA, as shown on Drwg Nos 1068-000, 1068-001 and 1068-002, all received on 6 March 2014, subject to the following condition:
