## Ref: APPLICATION FOR CERTIFICATES OF LAWFULNESS

Following helpful advice from Mrs C. Crowe (of Planning Dept.), we are applying for Certificates in respect of improvements in the past made to buildings on our property. One is for conversion of a small pergola into a garden shed and the other for the addition of doors to our domestic use garage block and for field access aprons from the adjacent drive.

Accordingly, we have enclosed:-
(i) A plan indicating our registered land boundaries. SEE (A)
(ii) A plan indicating the position of the garden shed and garage block, relative to the house, drive and parking/turning area, relevant to the improvements referred to above. SEE (B)

Dealing in turn with:-

### 1. Converted Small Garden Shed

When we purchased the property in March 2013, included was a small oak frame pergola, with tiled roof in a field reached by steps from the apron fronting the house and garage block.

This pergola was built at the same time as the house, oak frame garage block, apron with railed retaining walls and nearby Septic tank, in 2008.

In June 2015, sides with windows and a door were added to the frame to produce a small secure garden shed.
(SEE invoices and finished shed 2,3 \&4).
It has been used to hold gardening tools, etc for the past 10 years.
A CERTIFICATE OF LAWFULNESS is now sought for the enclosing conversion please.

## 2.Garage Block & Drive Access Aprons To Fields

The garage block was originally built, along with the house, apron, retaining walls, septic tank, etc in 2008 under Planning Approval 07/021292/8, dated 10.3.08 and retrospective Approval 09/00870/R and Building Control Certificate of Completion 08/07095/DOM, dated 18.2.09.

(SEE photo of oak framed building 5(a) & (b)). In May 2015, electric up & over doors were added to prevent driving rain, direct wind and to improve security for the domestic garage use. (SEE Garage Door & Gate Automation Invoice (6)). If needed can this improvement be included in the CERTIFICATE OF LAWFULNESS please?

In any event in 2017, Auldyn Construction were engaged to rebuild and extend the existing drive, as per Planning Approval 16/00372/8, dated 19.7.16. They employed COLAS IOM as a sub-contractor to supply and lay tarmac surfacing. Unfortunately, the tarmac laying machine accidentally "rammed" the garage block at 1.15pm on 12.6.17, causing significant damage to the core oak subframe.

In consequence, Colas via their insurer, undertook to replace the subframe and rebuild the block, using materials recovered during the careful dismantling of the damaged building. (SEE Colas email (7)).

They employed TVW of Laxey, as an oak frame building specialist to undertake the work, to be funded by the Colas insurer.

Accordingly, TVW dismantled the garage retaining undamaged/repairable parts for storage and subsequent re-assembly.

TVW managed to secure a new oak frame kit from France to exactly fit the existing concrete slab base, albeit with a slightly different door format.

(SEE kit drawings 8 & 9). The rebuild/re-assembly was completed in mid-November 2017. (SEE photos 10 & 11). In February 2018, Gate Automation re-fitted 3 recovered doors plus 1 new door. (SEE invoices and photo 12 & 13).

If it is determined that the slight modification to the front format, occasioned by frame availability, requires approval, can this be covered in a CERTIFICATE OF LAWFULNESS please?

At the same time that Colas were finishing the drive surfacing in 2017, Auldyn were in the process of completing their drive contract.
A specific condition (number 4) of the Planning Approval referred to above, was that - "within 2 months of driveway completion, a 1 m high
post and rail fence shall be erected along the boundaries of the new section of drive".
Clearly as it bisected a field, it required the insertion of an access apron each side to enable machinery etc entry/exit. Obviously these two access ways were located where the drive gradient was lowest as indicated in arial and ground level photos.

These access aprons were necessitated by the fencing condition and accordingly envisaged by Planning and Contractor but in any event, can these please be covered by a CERTIFICATE OF LAWFULNESS?
