## Officer’s Report

1.0 Description - 1.1 The proposed application (24/00570/CON) for Registered Building Consent for demolition elements to PA 24/00569/B was approved by the Planning Committee on (28.10.2024) subject to 5 conditions, some of which required submission of additional information prior to the commencement of works. - 1.2 This report is specific to Condition (5) which the applicants are seeking to satisfy. - 1.3 Specific wording of the condition as follows:

Works of demolition shall not be carried out until a contract that allows for the carrying out of works of redevelopment has been made and planning permission has been granted for the redevelopment for which the contract provides.

Reason: In order to prevent a gap site/sites in the Conservation Area, which would harm its character and appearance.

2.0 Proposal - 2.1 The applicant's agent has submitted documents outlining position for the construction of the development taking place the along with an application form on the 09.01.2025. - 2.2 A letter has been provided confirming the position of the contractor in relation to the proposed development taking place. This states: "The applicant has confirmed his company Hesketh Investments Limited will be constructing the development. Mr K. Lord will be overseeing the construction himself with the support of a site-based project manager and will be employing local contractors for the construction of the development. We would also highlight that the applicant has been a property developer operating on the Isle of Man since 1977 and in that time has constructed multiple developments." 07.01.2025

4.0 Recommendation - 4.1 In this instance of the submitted documentation and after consultation with the case officer confirming that they are happy with the level of detail, it is deemed sufficient to achieve the desired outcome and would be considered satisfactory for the planning condition 5 of application 24/00570/CON under the understanding that the development shall not be carried out unless in accordance with the approved details.

I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded Interested Person Status
