Plans/Drawings/Information; This decision relates to drawings 100 and 101 both received on 28th March, 2019. _______________________________________________________________ ## Interested Person Status Additional Persons none _____________________________________________________________________________ Officer’s Report THE SITE 1.1 The site is a section of west and east quays and the bridge in between, known as Fenella Bridge. This is a footbridge which links Weatherglass Corner (or colloquially known as Spit Corner) with West Quay near Fenella Beach. 1.2 The bridge currently has its own type of lighting which contrasts with the street lighting on west and east quays. THE PROPOSAL 2.1 Proposed is the removal of all of the lighting on the quays and on the bridge and their replacement with four new lights which incorporate CCTV. Two of the locations for the lights are the same as the existing (on the two quays). - 2.2 The lighting will be the same height as the existing street lights (8m - the bridge lights are slightly shorter) and will have two lamps on the top with the CCTV mounted further down on a swan-neck bracket. PLANNING POLICY 3.1 The site is designated as Mixed Use on the East Quay side and Public Open Space on the West Quay side. The East Quay is within the town's Conservation Area. - 3.2 There are no relevant Local Plan policies although the upgrading of East Quay is recommended and the section on Conservation advises that careful consideration should be given to various aspects of the town including street lamps. The most relevant policy in the Strategic Plan is that which requires development within a Conservation Area to preserve or enhance the character or appearance of the Area (EP35) which echoes the provisions of the Planning Policy Statement 1/01 - Conservation of the Historic Environment of the Isle of Man. PLANNING HISTORY 4.1 The footbridge was approved under 01/02255/B as part of a water retention scheme with a later application, 07/00910/B for the creation of the boat park. REPRESENTATIONS - 5.1 No representations have been received at the time of writing. ASSESSMENT - 6.1 The current situation is that there is a number of different lighting styles, combined with flagpoles on Weatherglass Corner. The reduction in upright features within the streetscene will make the environment less cluttered and more attractive and the style is not unlike the taller of the two lighting types already on site. CONCLUSION - 7.1 The impact of the proposal will be an enhancement of the Conservation Area and the area generally and the application is supported. INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons: - (a) The applicant, or if there is one, the applicant's agent; - (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested; - (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material - (d) Highway Services Division of Department of Infrastructure and - (e) The local authority in whose district the land the subject of the application is situated. 8.2 The decision maker must determine: - o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and - o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status.
