### Officer’s Report

## - 1.0 SITE

1.1 The site is 'Sunny Bank', a traditional detached bungalow on Lower Rencell Hill in Laxey which front directly onto the road and sits between an industrial shed and Queens Hotel. The site gives way steeply to the north east and features a narrow sliver of land running from the northern elevation of the dwelling parallel to the road for some 50 metres. - 1.2 The bungalow has been recently refurbished with cream painted render, and features a rendered boundary wall across the front and northern side, with a low timber fence bounding the narrow piece of land to the road.

2.0 PROPOSAL - 2.1 Proposed is the replacement of the existing roadside boundary wall with a sloping topped 0.6m high wall rendered and painted to match the main dwelling. The wall would feature two timber gate openings. It will be somewhat similar to the existing wall. Also proposed is the replacement of the existing low level timber fencing with taller timber fencing supported by concrete posts to 1.6m in height.

3.0 PLANNING HISTORY - 3.1 There is no planning history which is regarded as materially relevant to this application.

4.0 PLANNING POLICY - 4.1 The site is within an area zoned as Mixed Use for residential, retail and office use as per the Laxey and Lonan Local Plan 2005. The site is also within Laxey Conservation Area. - 4.2 General Policy 2 of the Isle of man Strategic Plan 2016 is key:

"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality."

4.3 Environment Policy 35 is also important given the location of the site:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

4.4 This echoes the provisions of Planning Policy Statement 1/01 - Conservation of the Historic Environment of the Isle of Man.

5.0 REPRESENTATIONS - 5.1 No representations or comments received at the time of report.

6.0 ASSESSMENT - 6.1 The key consideration here is the visual impact on the character and appearance of the bungalow, the street scene and the wider Laxey Conservation Area from the proposals. - 6.2 The wall would be similar in appearance to the existing one and would fit with the design and finish of the dwelling. Its height of 0.6m would not be out character with the bungalow or the area. It would respect the traditional appearance of the site and therefore the character of the Conservation Area.

6.3 The fence would be the most noticeable change to the sites appearance due to the a more solid appearance and a notable increase in height. Its timber and concrete construction would not be unacceptable however for the boundary fence between the road and the narrow piece of land forming part of the site to the north. The large industrial corrugated building behind ensures that there would be no loss of public outlook from the road.

7.0 CONCLUSION - 7.1 In summary, the proposal would result in no negative impact to the site or Laxey Conservation Area and complies with the aforementioned policies. The application is recommended for approval.

8.0 INTERESTED PERSON STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 Article 6(4), the following persons are automatically interested persons:

- (a) The applicant, or if there is one, the applicant's agent;
- (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material
- (d) Highway Services Division of Department of Infrastructure and
- (e) The local authority in whose district the land the subject of the application is situated.

8.2 The decision maker must determine:

- o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and
- o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status.
