TOWN AND COUNTRY PLANNING ACT 1999 The Town and Country Planning (Development Procedure)(No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Environment, Food and Agriculture determined to APPROVE an application by Island Exhaust Systems, Ref 18/00610/C, for the Change of use of industrial units to vehicle servicing, repairs and sales (retrospective) at Unit 1-2 Old Quarry Douglas Head Industrial Estate Douglas Isle Of Man IM1 5BF subject to compliance with the following condition(s) and notes (if any):

- 1. The use of the external areas shall be operated in accordance with the submitted, additional site plan, date-stamped as having been received 08 January 2019. Such areas shall not be used for any purpose other than the parking and turning of vehicles associated with the development and shall remain free of obstruction for such use at all times.

Reason: To ensure that sufficient provision is made for off-street parking and turning of vehicles in the interests of highway safety in accordance with General Policy 2 and Transport Policy 7 of the Isle of Man Strategic Plan 2016.

- 2. No motor vehicles shall be displayed for sale on the application site outside of the area as highlighted on the submitted, additional site plan, date-stamped as having been received 08 January 2019. The use of the vehicle sales area shall only be used in association with the main vehicle servicing and repairs business and shall not be operated as a separate or independent business.

Reason: To safeguard the industrial use of the site and ensure proper control of the development to avoid any future, undesirable fragmentation of the curtilage in accordance with General Policy 2 and Business Policy 5 of the Isle of Man Strategic Plan 2016.

- 3. No servicing of/or repairs to vehicles as part of or associated with the garage use, hereby approved, shall be undertaken outside the building or on the application site.

Reason: To safeguard the amenities of occupiers of adjoining properties in accordance with General Policy 2 of the Isle of Man Strategic Plan 2016.

-  Payment of a planning appeal fee as prescribed in the Town and Country Planning (Application and Appeal Fees) (No2) Order 2016 (currently £175);
-  The reasons for making the appeal; and
-  An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.
