1.1 The application site is the residential curtilage of 1 Douglas Street Peel and existing three story dwelling situated in the centre of Peel fronting directly on to the public highway and adjacent to Market Place. - 1.2 The mid terrace property has recently been subject to a number of roof repair works including the re-felting of the existing roof and replacement of the existing velux window to eradicate the internal damp issues. - 1.3 The existing roof slates that were in good condition were removed and retained. Upon completion of the felt and battening of the roof the existing slates were re-installed and those of poor condition were replaced with like for like slates.

1.4 The existing velux was not retained due to its severe level of deterioration and as such was replaced with a new like for like velux. - 1.5 The site is within the Conservation Area of Peel. PROPOSAL

2.1 The current planning application seeks approval for the retrospective repair of the roof and the installation of a replacement velux roof light. - 2.2 No other alterations are proposed. PLANNING HISTORY

3.1 No other planning applications are considered relevant in the assessment of the current application. PLANNING POLICY - 4.1 In terms of local plan policy, the application site is in an area zoned as "Mixed Use" under the Peel Local Plan 1989. As previously mentioned, the application site is within the Peel Conservation Area.

4.2 Given the nature of the proposal the Isle of Man Strategic Plan 2016 contains one policy considered specifically material to the assessment of this current planning application: - 4.3 Environmental Policy 35 states:

"Within Conservation Areas, the department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

REPRESENTATIONS

5.1 Peel Town Commissioners have indicated that they have no objection to the current application. 12/10/2017

5.2 The Department of Infrastructure Highway Services have indicated that there is no highways interest in this planning application (29/09/2017). ASSESSMENT - 6.1 Repair and restoration is the first and foremost desire for any development works within a Conservation Area, where repair is impracticable it is sought for the development works to preserve or enhance the character of the Conservation Area.

6.2 In this instance the repair was required on the underside of the existing roof slates. The applicant has endeavored to retain all the existing slates where possible to ensure the character of the property was preserved and where existing slates were unsuitable the applicant has installed like for like slates to ensure that the roof maintains a uniform appearance throughout.

6.3 The development works included the replacement of the existing roof light with new, while there is no evidence supplied of the previous roof light the proposal now due to its size, design and position on the roof slope is not considered to impact the appearance of the existing property or to detriment the character of the streetscene or the wider Conservation Area to warrant a refusal. CONCLUSION

7.1 Although the roofing works have been completed without prior planning approval the applicant has strived to preserve the character of the Peel Conservation Area through the reuse of the existing slates.

7.2 The planning application complies with EP35 of the IOM Strategic Plan 2016 and is therefore recommended for approval.

INTERESTED PERSON STATUS 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013 (Article 6(4), the following persons are automatically interested persons:

- (a) The applicant, or if there is one, the applicant's agent;
- (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material
- (d) Highway Services Division of Department of Infrastructure and
- (e) The local authority in whose district the land the subject of the application is situated.

8.2 The decision maker must determine:

- o whether any other comments from Government Departments (other than the Department of Infrastructure Highway Services Division) are material; and
- o whether there are other persons to those listed in Article 6(4) who should be given Interested Person Status.
