## Officer’s Report

1.0 THE SITE - 1.1 The application site is the curtilage of No. 8 Kissack Road, a single storey detached dwelling with rooms in the roof accommodation sited on the north western side of Kissack Road in Castletown. - 1.2 Kissack Road is predominantly characterised by single storey dwellings, some of which have had dormer extensions. There are a number of noticeable similarities between the dwellings along Kissack Road, white render, shallow-pitched roofs and stonework is common to all the dwellings. The orientation of the bungalows is mixed, with the majority having a rectangular frontage and a small handful with gable ends facing the highway.

2.0 PLANNING HISTORY - 3.1 The application site has been the subject of two previous planning applications that were granted planning permission and have been listed below: 15/00271/B: Erection of an extension to rear of existing garage - approved PA 08/00959/B: Erection of conservatory - approved PA 92/00051/B: Erection of rear extension - approved

3.0 THE PROPOSAL - 3.1 Full planning approval is sought for the replacement of the existing conservatory roof with a new roof lean to roof with light weight tile to match the main dwelling, brown.

## - 4.0 DEVELOPMENT PLAN POLICIES

4.1 The application site is within an area zoned as "Predominantly Residential" identified on the Area Plan for the South 2013. The site is not within a Conservation Area. Given the nature of the application it is appropriate to consider General Policy 2 of the Isle of Man Strategic Plan.

4.1 In terms of local plan policy, the application site is in an area designated as Predominately Residential use under the Area Plan for the South 2013. - 4.2 General Policy 2 states (in part): "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (b) Respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) Does not affect adversely the character of the surrounding landscape or townscape, and (g) Does not affect adversely the amenity of local residents or the character of the locality."

## - 5.0 REPRESENTATIONS

5.1 Castletown Town Commissioners have no objection to the current planning application. 06.04.2016.

5.2 DOI Highways - no highways implications. 23.03.2016. - 6.0 ASSESSMENT

6.1 The application seeks approval for the installation of a replacement conservatory roof. The main issue to consider in the assessment of the application is the impact upon the character and appearance of the property and the surrounding area.

6.2 As the proposed roof tiles would match the existing roof tiles of the main dwelling it is considered that the development would be an enhancement to the existing property by providing a uniform appearance throughout. - 6.3 The replacement conservatory roof would be mainly visible from the surrounding properties. The proposed conservatory roof tiles, which would be a colour to match that of the dwelling, will provide a more constant appearance than is currently the case and thus enable a more successful integration of the conservatory with the dwelling itself, enhancing the appearance of the dwelling as viewed from neighbouring properties. - 6.4 As a result, it is concluded that the planning application does not conflict with General Policy 2 (b), (c) or (g) of the Isle of Man Strategic Plan 2007.

## - 7.0 RECOMMENDATION

7.1 In view of the above, the application is recommended for approval. - 8.0 INTERESTED PERSON STATUS

8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons:

- (a) The applicant, or if there is one, the applicant's agent;
- (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material , in this case, Department of Infrastructure Highway Services and (e) The local authority in whose district the land the subject of the application is situated.

With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

This approval relates to drawing no JTM-108-P-01 date stamped received 16 March 2016.
