## Officer’s Report

1.0 THE APPLICATION SITE - 1.1 The application site is the residential curtilage of Tillyloss, a single-storey detached dwelling with accommodation in the roofspace, and which is located on the western side of West Baldwin Road, West Baldwin. - 1.2 Tillyloss is well-screened from West Baldwin Road given the significant tree planting along the western side of the highway and eastern boundary of the application site.

2.0 THE PROPOSAL - 2.1 The current planning application seeks approval for the installation of a two pitched roof dormers: one would sit on a north-facing roof slope to serve a bedroom/study, while the other would sit at 90 degrees to this on a west-facing roof slope and which would serve a bathroom. - 2.2 The proposed dormers would be finished in materials to match the existing dormer windows and roof tiles of the main dwellinghouse.

## - 3.0 PLANNING HISTORY

- 3.1.1 The application site has been the subject of a number of planning applications between 1991 and 2005 for a number of alterations and extensions to the existing dwelling. Of specific relevance is the approval granted to PA 15/01038/B, which sought and gained approval for the north-facing dormer and a rooflight in place of the west-facing dormer.
- 3.1.2 The case officer's assessment ran as follows:

"The proposed dormer would not be sited within close proximity of any neighbouring dwellings and therefore it is not considered it would be adverse to the private amenity of neighbouring properties.

"Due to the height of the boundary and location of the dormer to the rear of the application dwelling, it is unlikely that the dormer will be readily visible in its entirety from the highway. It is therefore considered that the proposal would not adversely affect the street scene or public amenity in general. Given the scale of proposed dormer, it is not considered it will impact significantly on the appearance of the dwelling."

## - 4.0 PLANNING POLICY

4.1 The application site is within an area zoned as 'White Land' 'Open Space' under the Braddan Local Plan 1991. - 4.2 Probably of most relevance to the assessment of this application is the Strategic Plan's Housing Policy 16; the general development criteria as set out in General Policy 2 are also helpful to note.

## - 5.0 REPRESENTATIONS

5.1 Marown Parish Commissioners have no objection to the current planning application (22.07.2016). - 6.0 ASSESSMENT

6.1 In common with the previous application on this site, the proposed dormers would be unobtrusive. They would be kept away from public view but in any case satisfactorily complement the existing dormers. They would not appear above the dwelling's main ridgeline and so are appropriately subordinate in form, mass and style, and moreover would not increase the impact of the dwelling as viewed from the public. - 7.0 RECOMMENDATION

7.1 For the reasons set out above, it is considered that the development proposed is acceptable in the context of General Policy 2 and Housing Policy 16 and accordingly is recommended for approval. - 8.0 INTERESTED PERSON STATUS

8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons:

- o The applicant, or if there is one, the applicant's agent;
- o The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- o The local authority in whose district the land the subject of the application is situated.

With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word 'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order.

C 1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

The development hereby approved relates to the Site Plan, the Location Plan, and Drawing 04/4114/1(C), all date-stamped as having been received 17th June 2016.
