Officer’s Report THE SITE

1.1 The site is the curtilage of an existing building situated on the southern side of Port Jack Glen fronting onto the bottom end of Royal terrace. The authorised use of the premises is for the sale of hot and cold food and drink (PA 09/00768/C). - 1.2 The building is two storied with the upper floor being contained within a mansard, similar to the others in the row but this property is finished with slate hanging, the others being finished in red asbestos tiles hung in a diamond format. The property has a small projecting canopy, smaller than those to the south serving the commercial premises there. - 1.3 The property has been upgraded with a pale turquoise colouring to the top parts of the glazed frontage. There was at the time of the site visit, seating outside the frontage which does not appear to have the benefit of planning approval. The applicant and Department of Infrastructure Highway Services have been notified of this. THE PROPOSAL

2.1 Proposed is the installation of a signage board above the main windows to advertise the name and nature of the premises - Delissimo sandwich deli which accords with the authorised use of the premises. The signboard would be wooden with vinyl lettering and background on top. The sign will not be illuminated. - 2.2 Also proposed is the fixing of vinyl lettering on the front window advertising items for sale in light coloured Italic lettering which appears to be in situ. PLANNING POLICY

3.1 The site lies within an area designated on the Onchan Local Plan of 2000 as "Shopping": the site is not within a Conservation Area although the local plan identifies at paragraphs 7.2 and 7.9 that an area around Port Jack should be considered for designation as a Conservation Area. This has not been progressed to date but it is unlikely that the application building and structures alongside are part of the interesting or historic architecture which prompted that suggestion. - 3.2 The development should be assessed in accordance with the following Strategic Plan policies:

"Within our towns and villages, the display of external advertisements will be permitted on the site or building to which they relate provided they:

- a) are of a high standard of design and material and relate well to the building and site on which they are to be displayed;
- b) are in keeping with and do not detract from the surrounding area; and

- c) are located so as to not cause a highway safety hazard" (General Policy 6). and

General Policy 2 states: "Development which is in accordance with the land use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the space around them;
- c) does not affect adversely the character of the surrounding landscape or townscape". PLANNING HISTORY

4.1 Other than the above application, no planning applications have been submitted in respect of this site. REPRESENTATIONS - 5.1 Onchan District Commissioners indicate that they approve the application (25.05.16).

5.2 Department of Infrastructure Highway Services indicate that there is no highway interest in the proposal (27.05.16). ASSESSMENT - 6.1 The issue in this case is whether the proposed signage is considered appropriate in its context and in this respect it is relevant to consider the existing form and character of the buildings close by. The buildings immediately to the north east are residential so the omission of any lighting is welcome. The properties to the south and south east are commercial at ground floor level and have a variety of signs and window vinyls. What is proposed, by contrast is muted and subtle and as such, acceptable in its context.

6.2 The application is recommended for approval.

## PARTY STATUS

By virtue of the Town and Country Planning (Control of Advertisements) Regulations 2013, the following persons are automatically interested persons:

- (a) The applicant, or if there is one, the applicant's agent;
- (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- (c) Persons to whom notice has been given under regulation 10(3)(a)(i)
- (d) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material;
- (e) The Highways Division of the Department of Infrastructure;
- (f) The Ports Division of the Department of Infrastructure;
- (g) The operator of the railway or tramway; and
- (h) The local authority in whose district the land the subject of the application is situated.

Reason: To avoid the accumulation of unimplemented advertisement consents. This permission relates to drawings JTM090-P-00, JTM090-P-01- existing and JTM090-P-01 Proposed all received on 9th May, 2016.
