## Officer’s Report

1.0 THE APPLICATION SITE - 1.1 The application site comprises the curtilage of Shellag, Chapel Hill, Bride. A detached dwelling, with garage, located within Bridge village, the site is located on the northeastern side of the road that leads southeast from the A16 Bride to Point of Ayre road, past Lambhill and towards the A10 road. Opposite the site is Bride Methodist Church. - 1.2 This part of the road rises up from the roundabout at Cranstal Road/Lamb Hill junction.

2.0 THE PROPOSAL - 2.1 The application is for the erection of a single storey rear extension, 6m x 6m x 2.4m (eaves) x 4m (ridge). Materials to match existing house, - white render and slates. - 2.2 The plans also show the conversion of the garage to an ensuite bedroom, with replacement of garage door with window.

3.0 PLANNING HISTORY - 3.1 The application site has no previous planning history.

4.0 PLANNING POLICY - 4.1 In terms of land use designation the application is located within a wider area of land that is designated as residential under the Isle of Man Planning Scheme (Development Plan) Provisional Order 1982. - 4.2 In terms of strategic plan policy, the Isle of Man Strategic Plan 2016 contains one policy that is considered specifically material to the assessment of this current planning application. The relevant extract of General Policy 2 states: "Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape; (g) does not affect adversely the amenity of local residents or the character of the locality;

4.3 Paragraph 8.12.1 advises that there will be a general presumption in favour of extensions to residential properties where this would not have an adverse impact on either adjacent property or the surrounding area in general.

5.0 REPRESENTATIONS - 5.1 The Department of Infrastructure Highways Division do not oppose the planning application as there is sufficient parking remaining. 22.6.16 - 5.2 Bride Commissioners have no objection. 09.07.16.

6.0 ASSESSMENT - 6.1 The main issues in the consideration of the application are the impact on the main dwelling, the neighbouring property and wider views of the rear of the property. - 6.2 Visiting the area and viewing the proposed plans the proposed extension to the rear elevation will not be apparent from Chapel Hill. Those mostly likely to see it is the neighbouring property and those at Lamb Hill Road. In respect of the latter they are some 30ms away (boundary to boundary) therefore is not considered that the proposal will affect them. The neighbouring property is set on a higher level than the application site by apx 1m so while is it close to the boundary the ground level differences will put the extension at about 3m high from their garden, on this basis is not considered that the proposal will unduly harm the amenity of the neighbouring property such to warrant a refusal. - 6.3 The proposed extension would also follow the proportion, form and finish of the existing dwelling and therefore it is considered this aspect is also acceptable. It is also considered that the proposed development would not have a harmful impact on the character and appearance of the surrounding area in general. - 6.4 Therefore it is considered that the proposals complies with parts (b), (c) and (g) of General Policy 2.

7.0 RECOMMENDATION - 7.1 It is recommended that the planning application be approved.

8.0 PARTY STATUS - 8.1 By virtue of the Town and Country Planning (Development Procedure) (No 2) Order 2013, the following persons are automatically interested persons:

- (a) The applicant, or if there is one, the applicant's agent;
- (b) The owner and the occupier of any land that is the subject of the application or any other person in whose interest the land becomes vested;
- (c) Any Government Department that has made written submissions relating to planning considerations with respect to the application that the Department considers material , in this case, Department of Infrastructure Highway Services and (e) The local authority in whose district the land the subject of the application is situated.

Department of Environment, Food and Agriculture Fisheries are part of the same Department as is the planning authority and as such should not be afforded interested person status under the Order.

With effect from 1 June 2015, the Transfer of Planning & Building Control Functions Order 2015 amends the Town and Country Planning Act 1999 to give effect to the meaning of the word

'Department' to be the Department of Environment, Food and Agriculture unless otherwise directed by that Order. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

This approval relates to Location Plan, Site Plan Drawing No 1 Sheets 1, 2, 3 and 4 all date stamped received 9 June 2016.
