## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) (No 2) Order 2013

In pursuance of powers granted under the above Act and Order the Department of Infrastructure determined to **APPROVE** a planning application by Pawel Michal Bednarski, Ref **14/00714/GB**, for the installation of replacement window (in association with PA 14/00715/CON) at Flat 1 4 Harris Terrace Douglas Isle Of Man IM1 3LZ subject to compliance with the following condition(s):

1. The development hereby approved shall be begun before the expiration of four years from the date of this decision notice.

Reason: To comply with article 14 of the Town and Country Planning (Development Procedure) (No2) Order 2013 and to avoid the accumulation of unimplemented planning approvals.

2. The Glazing Bar details and sash 'Horns' to the exterior elevation shall replicate those highlighted/added by the applicant in the literature submitted by DPM Conservatories dated 11/7/2014 and received by the Department on 14th July 2014. Glazing Bar profile sections and dimensions to comply with details as forwarded to DPM by Building Conservation for consideration on 16th July 2014.

Reason: The inclusion of 'Horn' details to the sashes and glazing bar profiles are central to correctly emulating the style of the original windows.

3. The glazing bar details and sash 'Horns' to the exterior elevation shall replicate those as highlighted/added by the applicant in the literature submitted by DPM Conservatoires dated 11/7/2014 and received by the Deaprtment on 14th July 2014.

Glazing bar profile sections and dimensions to comply with details as forwarded to DPM Conservatories for confirmation by the Department dated 16th July 2014.

Reason: The inclusion of sash 'Horns' and correct glazing bar profiles and dimensions are central to correctly emulating an authentic Georgian period sliding sash window.

This approval relates to the following information;

Site Plan Scale 1:200

Additional information supplied by the applicant's agent DPM Conservatories and amended by Mr Bednarski;

A4 written quotation dated 11/7/2014 and received 14th July 2014 - Elevation drawing/printout with window Horn and Glazing Bar details added.

A4 clarification of replacement window detail as forwarded to DPM on 16th July 2014 by the Department

### Guidance Note

This decision was made by the Head of Development Management in accordance with the authority delegated to her in the name of the Minister and/or in the name and on behalf of the Department.

This permission refers only to that required under the Town and Country Planning (Development Procedure) (No 2) Order 2013.

Any appeal against this decision must be in accordance with Article 8 of the Order.

A valid appeal must be in writing, signed by the appellant, and submitted to the Department within 21 days of the date of this Notice. To further validate the appeal it must contain:

- Payment of a planning appeal fee as prescribed in an order made by the Department under Section 1(1) of the Fees and Duties Act 1989 (currently £150);
- The reasons for making the appeal; and
- An election to have the appeal conducted by means of an inquiry (a hearing) or by means of written representation.

Please note that a copy of the Officer's report which led to the decision, together with correspondence relative to the application, are available for inspection at the Department.

The proposed development must not be commenced until either;

- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

If no appeal is lodged within 21 days of the date of issue overleaf, and this decision becomes final, the Department's public reference copy (counter copy) of the planning application may be collected by the applicant or their agent from Murray House.

Please note that if the counter copy of the application is not collected within THIRTY DAYS following the last date on which a planning appeal can be made it will be destroyed without further notice.
